  • Were Penalized for not gaming your sales numbers
  • Failed to meet sales quotas because you did not engage in fraudulent activity
  • Were demoted, fired, or forced to resign after complaining or reporting unethical behavior to the company’s ethics line?

YOU MAY BE ELIGIBLE TO RECEIVE COMPENSATION FROM WELLS FARGO

Wells Fargo forced knowingly unrealistic cross-sell quotas on their employees, pushing them to open eight or more accounts for every customer. The scheme allowed higher level workers to squeeze low-level employees into meeting these objectives by opening more than 2 million accounts for customers who did not want or need them. Employees were fired for these activities, while Wells Fargo executives reaped significant financial benefits and thousands of low-wage workers took the blame.

Instead of rewarding workers who resisted engaging in fraudulent activity, Wells Fargo forced them to resign, demoted them, or fired them for not reaching cross-sell goals.

We believe that Wells Fargo punished workers who had the moral fortitude to resist engaging in fraudulent activities. We believe the company violated federal financial regulations and labor laws through this fraudulent activity, and wrongfully terminated the workers who wouldn’t go along. We believe the bank conducted unlawful business practices and failed to pay workers according to federal overtime laws.

THE IMPORTANCE OF THE U5
The U5 database system is maintained by the Financial Industry Regulatory Authority (FINRA), and contains the “report cards” of all bankers. Banks are required by law to report any type of wrongdoing on an employees’ U5. The system was designed to ensure bankers, financial advisers, and brokers are held accountable for any type of violation or unethical behavior. However, getting a negative comment on your U5 can essentially lead to being blackballed within the industry, leaving these workers unable to get jobs in their fields. And trying to get a U5 changed, even if the comment was made in error, is very expensive and there is no guarantee that a change will be made.
